Goodmore Safety Group — Storm Callout SMS Program & Application Terms
These Terms and Conditions ("Terms") govern your use of (a) the Goodmore Safety Group SMS text-messaging program for storm-callout dispatch (the "Storm Callout Program") and (b) the Goodmore Safety Field Crew Management Application (the "Application"). By opting in to the Storm Callout Program or by using the Application, you agree to these Terms.
Program name: Storm Callout Notifications
Program operator: Goodmore Safety Group ("Goodmore," "we," "us"), operating the program on behalf of utility-line contractors that subscribe to our Storm Calls feature ("Contractors").
Program purpose: To notify pre-registered field workers ("Subscribers") of storm-related dispatch events, mobilization instructions, foreman contact information, and related safety communications.
You become a Subscriber by:
Your phone number, name, and any other information you provide are stored securely and used solely to operate the Storm Callout Program for the Contractor you signed up with. See our Privacy Policy for full details on data handling.
Message frequency varies based on storm activity and the Contractor's dispatch needs:
Goodmore does not control the frequency of Contractor-initiated messages. The Contractor decides when, and how often, to dispatch storm callouts to its list.
Message and data rates may apply. Goodmore does not charge Subscribers for messages, but your wireless carrier may charge for incoming SMS, MMS, or replies. Contact your wireless carrier for details about your plan's rates.
Goodmore is not responsible for delays in message delivery caused by your carrier, your device, or factors outside Goodmore's reasonable control.
The Storm Callout Program is compatible with all major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, US Cellular, Sprint, Boost, Cricket, Metro by T-Mobile, and most regional carriers. Carriers are not liable for delayed or undelivered messages.
After you reply STOP, you will receive a single confirmation message confirming that no further messages will be sent. You will not receive any other storm-callout messages from the Contractor unless you explicitly re-subscribe.
To re-subscribe after opting out, reply START to the same number, or complete the signup form again.
Consent to receive messages is not a condition of any purchase, employment, or service. There is no fee from Goodmore to participate in the Storm Callout Program. Wireless carrier rates may apply (see Section 4).
You must be at least 18 years of age and a resident of the United States to subscribe. By opting in, you represent that you are the account holder or authorized user of the mobile phone number provided, and that you have the right and ability to receive text messages on that number.
If your phone number changes or is reassigned, you must notify your Contractor or reply STOP from the old number so the previous Subscriber is properly removed.
Your phone number and SMS opt-in data are handled in accordance with our Privacy Policy. In summary:
The Storm Callout Program and the Application are provided "as is" and "as available" without warranties of any kind, express or implied. Goodmore does not guarantee that messages will be delivered, that the Application will be uninterrupted or error-free, or that defects will be corrected.
Field operations are inherently dangerous. Subscribers and Application users are responsible for their own safety, for following all applicable safety standards and regulations (including OSHA), and for exercising independent professional judgment. Storm callout messages and Application content are operational notifications — they are not a substitute for proper safety training, situational awareness, or supervision.
To the maximum extent permitted by law, Goodmore Safety Group, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to (a) the Storm Callout Program, (b) the Application, (c) any message that is delayed, undelivered, or misdelivered, or (d) any action or inaction taken in response to a message.
To the extent any liability cannot be excluded under applicable law, Goodmore's total cumulative liability shall not exceed one hundred U.S. dollars ($100).
You agree to indemnify and hold harmless Goodmore Safety Group, its officers, directors, employees, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your violation of these Terms, (b) your use of the Storm Callout Program or the Application, (c) your violation of applicable law, or (d) your infringement of any third-party right.
The Goodmore Safety Field Crew Management Application is licensed (not sold) to authorized employees and contractors of subscribing companies. You agree to use the Application only for its intended purpose: managing field operations, safety documentation, and crew coordination on behalf of your employer.
You may not (a) reverse engineer or attempt to extract source code from the Application; (b) share your login credentials with any other person; (c) use the Application to harass, threaten, or harm any other person; (d) upload content that infringes any third-party right or violates applicable law; or (e) use the Application in connection with any unlawful activity.
We may update these Terms at any time. Material changes will be posted on this page and the "Last Updated" date will be revised. Continued use of the Storm Callout Program or the Application after changes are posted constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the United States and the state in which Goodmore Safety Group is organized, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts of competent jurisdiction in that state.
